Reminder and Alert: The business practices of the SOCIETE DE MANUFACTURES ET DE PRODUCTION INDUSTRIELLE DU SENEGAL (SOMAPIS SARL) are under judicial scrutiny
On 11 September 2024, we published an article entitled:
‘Alert: Suspected Unfair Commercial Practices by the Société de Manufactures et de Production Industrielle du Sénégal (known as SOMAPIS SARL)’, in which we drew attention to commercial practices requiring further investigation.
Today, the recent conviction of SOMAPIS SARL by the Dakar Special Commercial Court in a case pitting this company against La Société Futuriste Immobilier SARL serves to reinforce our concerns.
The facts:
In this ruling, SOMAPIS SARL was ordered to:
- Pay 54,683,000 FCFAas the main claim.
- To pay an additional 5,000,000 CFA francs in damages for all losses combined.
- To pay the costs.
We welcome this court ruling, which demonstrates the institutions’ commitment to ensuring fairness and transparency in commercial relations. However, we believe that this case serves as a further warning, justifying increased scrutiny by the judicial and administrative authorities of the activities of this company and its directors.
A call for vigilance:
We are issuing a call to the judicial authorities and tax regulators to closely examine this company’s commercial practices, operating in a sector as sensitive as the sale of concrete. This sector relies on the exploitation of natural resources belonging to all Senegalese citizens and warrants strict regulation.
Practices requiring regulation:
Certain common practices in this sector, notably the frequent use of cash payments, can complicate the traceability of transactions and raise questions regarding compliance with tax obligations. We call on the tax authorities to strengthen control mechanisms to ensure that all companies, including SOMAPIS SARL, contribute fully to Senegal’s economic and fiscal development.
Conclusion:
This court ruling is not aThis is not a definitive outcome, but a strong signal to encourage transparent and law-abiding business practices. We urge the relevant authorities to continue monitoring this strategic sector and to carry out the necessary investigations to safeguard the interests of all citizens.
We will continue to follow this matter closely and keep our readers informed of any developments.
